The prosecution on Monday filed an indictment in the Tel Aviv District Court against Musa Zainab, a 30-year-old from Tel Aviv, accusing him of raping a complainant after she was allegedly drugged without her knowledge during an event the two had attended together.

According to the indictment, the complainant had no prior acquaintance with Zainab and met him for the first time at the event in Bat Yam on the evening of November 6, through and with a joint friend of theirs, identified as S.B.

The indictment notes that during the evening, the complainant consumed alcohol and, in a manner “unknown to the prosecution,” ingested a dangerous drug without her knowledge - specified as methamphetamine.

At around 12:25 a.m., the indictment states, Zainab decided to take the complainant to a motel in Bat Yam “in order to have sexual relations,” despite allegedly knowing she was intoxicated and cognitively impaired, and unable to provide free consent.

Security-camera-timed details cited in the indictment describe the pair arriving at the motel reception shortly after 12:31 a.m., with the complainant struggling to stand while Zainab held her. The indictment further alleges Zainab remarked to her - in the presence of the receptionist - “Baby, why did you drink so much?” or words to that effect, before the two entered a room.

Inside the room, prosecutors allege, Zainab raped the complainant by vaginal penetration while exploiting the fact that her senses were “blurred” by substances and she was unable to give free consent.

The indictment further details that after a conversation between Zainab and S.B., the latter entered the room; shortly thereafter, S.B. approached the receptionist and asked her to summon an ambulance, a request the receptionist refused, according to the indictment.

At about 1:18 a.m., per the indictment, Zainab and S.B. removed the complainant from the room when she was unable to move under her own power, holding her on both sides while she remained in a state of impaired consciousness and with her lower body unclothed.

They then allegedly walked her in that condition along a street in Bat Yam, placed her in S.B.’s car, and drove her to Wolfson Medical Center, where they brought her inside and left.

Beyond the rape charge, prosecutors also accuse Zainab of obstruction of justice. The indictment alleges that following the incident a criminal investigation was opened and that Zainab, aware of it, fled and hid, and was arrested only on November 24.

The prosecution submitted a request to keep Zainab detained until the end of proceedings.
